THE PARTIES. This Short-Term Rental Agreement (“Agreement”) or (“Reservation”) made on the date of the Guests reservation between the following:
GUEST: Guests name as defined in their booking confirmation or reservation and their invited, registered guests hereafter collectively known as “Guest”, or, "Releasor," "I" or "me" 
HOST: Wanderllama, LLC, aka, MISSING Hotel, aka MISSING Ranch, and Snoozefest, LLC hereafter known as “Host”, or “MISSING”, or "MISSING Hotel"
THE PREMISES. The Host agrees to lease the described property below to the Guest, and the Guest agrees to rent from the Host:
Address: 11980 S. FM 1174, Marble Falls, TX 78654. Hereinafter known as the “Premises.”
LEASE TERM. The Guest shall be allowed to occupy the Premises starting on Guests check-in date and ending on Guests check-out date as further defined in Guests booking confirmation or their reservation (“Lease Term”).The Guest agrees to abide by the terms, conditions and rules of the Host, hereafter referred to as (“Terms”):
QUIET HOURS. Quiet hours begin at 10:00 PM each night and continue until sunrise. Quiet hours consist of no music that can be heard by other guests and keeping all sound at a minimum level out of respect for the surrounding residents. 
OCCUPANTS. The total number of individuals staying on the Premises during the Lease Term shall be a total of the number of guests selected at booking and only those registered guests are permitted on the property. The Guest does not have the right to sublet the Premises.If more than the authorized number of guests listed above are found on the Premises, this Agreement will be subject to termination by the Host without refund to the Guest.
FEES. The Guest shall pay to the Host the full amount as detailed during the booking process. Guest authorizes Host to charge the payment method on file for the full amount inclusive of any and all taxes and fees at the time of booking. In addition, Guest authorizes Host to place a pre-authorization hold on the payment method on file prior to Guests arrival. Host may retain the details of any payment method on file by Guest to charge and as a security for the faithful performance of the Guest under the terms and conditions of this Agreement. Host may charge any credit card provided by Guest for any expenses, including but not limited to incidentals, damages or other fees incurred by Guest or discovered thereafter. 
QUIET ENJOYMENT. The Guest, along with neighbors, shall enjoy each other’s company in a quiet and respectful manner to each other’s enjoyment. The Guest is expected to behave in a civilized manner and shall be good neighbors with any residents of the immediate area. Creating a disturbance of the area by large gatherings or parties shall be grounds for immediate termination of this Agreement. Host will only give one warning to quieten down. Receiving a second complaint will result in the Guest being asked to leave without refund.
DAMAGES AND/OR REMOVAL OF PROPERTY. Host reserves the right to charge Guest the cost of replacing any items that are removed from the premises by them without consent or rectifying damage, caused by the deliberate, negligent or reckless act of the Guest to the hotel’s property or structure. The charge will be the full replacement amount of the missing item, including any additional charges incurred as a result to the payment method on file, regardless of the time this may come to light.
CANCELLATIONS. If a Guest cancels up to 30 days before check-in (original date of arrival), a refund will be given. After that, Guest may cancel up to 14 days before check-in and receive a 50% refund on the nightly rate for the stay. All cancellations are subject to any processing fees incurred by Host. Standard credit card authorization policies vary from bank to bank, and can take up to 14 business days to release. To notify Hosts of cancellation, Guests must notify the Host in writing via email to hello@missinghotel.com
Host provides an outdoor experience to Guest in a natural environment within tent-like structures or cabins on the Premises. Guest is aware of, and intends to book a stay with Host with the intention and knowledge of being in a natural outdoor environment. Given the Host is unable to control the natural environment on or off the Premises, Guest assumes the responsibility of preparing for this environment and natural elements thereof. These natural elements include but are not limited to: inclement weather, extreme temperatures, insects, pests, wildlife or loss of power or utilities. Furthermore, weather, flight changes, delays, cancellations or sickness impacting the travel to and from the Premises are outside the control of Host. Therefore, Guest assumes the risks and agrees their reservation is made rain or shine. Host will not provide a refund of any kind due to any aforementioned elements interfering or altering Guest’s stay or their inability to travel to Host for any reason. Host advises Guest to seek trip insurance available through outside parties for this reason. 
Rescheduling: The request must be submitted at least 30 days prior to the original arrival date. If the dates of stay are changed, guests agree to cover any additional costs if the new dates have higher room rates than the previous reservation.
If stay is rescheduled, the new reservation(s) will no longer be cancellable or refundable.
PETS. Host allows up to two well behaved dogs at an additional fee of $75 per dog. Dogs must be attended at all times and on a leash when outside for the safety of all guests and other dogs. If the Guest is found to have pets on the Premises, Host may charge Guest payment method on file for the applicable fee. Pet fees are not not applicable to Service Animals as defined by Texas Law and the ADA. Guest states to the best of their knowledge and experience that their pets will not pose a threat or danger to any other guests, occupants, invitees staying or visiting at or about the Premises. Pet must be kept and maintained in a manner that will not disrupt the peaceful enjoyment of by other residents; improper aggressive behavior by dog shall be deemed a breach of this Agreement and as a result, dog must be removed from the Premises. Guest acknowledges and agree that Guest shall be responsible for ensuring that pet shall not pose or cause any danger, damage, nuisance, undue noise, or health hazards while being present upon the Premises. Guest certifies and warrants that the Pet has no history of biting, no vicious tendencies, and does not exhibit aggressive behavior. Guest agrees not to leave Pet unattended within their accommodation and agrees that Pet shall be on a controlled leash when outside their accommodation on the Premises. 
SMOKING POLICY. Smoking of any kind within the accommodations is prohibited. A sanitization fee of $500 will be charged where smoking occurs within a guest room.
NON-ARRIVAL. Should Guest fail to arrive on the scheduled day of your reservation, Guest room will be held until the following day in case of any unforeseeably delays and are unable to contact Host. Should Guest not arrive the next day the Reservation will be canceled and the total accommodation charge will be applied to Guest's payment method on file. After check-in, should you shorten your stay, full payment will be forfeited.
REGISTRATION. Guest agrees to complete a registration form, sign any required documents and provide a valid form of identification prior to arrival.

INSPECTION. The Host has the right to inspect the Premises with prior notice as in accordance with State law. Should the Guest violate any of the terms of this Agreement, the rental period shall be terminated immediately in accordance with State law. The Guest waives all rights to process if they fail to vacate the premises upon termination of the rental period. The Guest shall vacate the Premises at the expiration time and date of this agreement.
MAINTENANCE AND REPAIRS. The Guest shall maintain the Premises in a good, clean, condition and use the Premises only in a careful and lawful manner. The Guest shall leave the Premises in a ready to rent condition at the expiration of this Agreement, defined by the Host as being immediately habitable by the next Guest. The Guest shall pay for maintenance and repairs should the Premises be left in a lesser condition. The Guest agrees that the Host shall deduct costs of said services from the payment method on file prior if Guest causes damage to the Premises or its furnishings.
TRASH. The Guests shall dispose of all waste material generated during the Lease Term under the direction of the Host.
CHILDREN. No unaccompanied minors on the property. Guests must be over the age of 21 to book a reservation.
HOST’S LIABILITY. The Guest and any of their guests hereby indemnify and hold harmless the Host against any and all claims of personal injury or property damage or loss arising from the use of the Premises regardless of the nature of the accident, injury or loss. The Guest expressly recognizes that any insurance for property damage or loss which the Host may maintain on the property does not cover the personal property of Guest and that Guest should purchase their own insurance for their guests if such coverage is desired.
ATTORNEY’S FEES. The Guest agrees to pay all reasonable costs, attorney's fees, and expenses that shall be made or incurred by the Host enforcing this agreement.
USE OF PREMISES. The Guest shall use the Premises for residential use only. The Guest is not authorized to sell products or services on the Premises nor conduct any commercial activity including an event or otherwise without prior consent of Host.
SAFETY. No campfires or outdoor burning of any type will be permitted during county or state mandated burn bans, and the Host reserves the right to disallow the use thereof in the event of any unsafe conditions. Guest must maintain safe and practical fire care including but not limited to never leaving a fire unattended and putting out the fire when finished. Guest may be liable to Host for any and all damages to property or people resulting from their negligent use thereof. 
ILLEGAL ACTIVITY. The Guest shall use the Premises for legal purposes only. Any other such use that includes but is not limited to underage drinking, illicit drug use, verbal or physical abuse of any person or illegal sexual behavior shall cause immediate termination of this Agreement with no refund of any payment.
POSSESSIONS. Any personal items or possessions that are left on the Premises are not the responsibility of the Host. The Host may make reasonable effort to return the item to the Guest. If claims are not made within the State’s required time period or two (2) weeks, whichever is shorter, the Host shall be able to keep such items to sell or for personal use.
GOVERNING LAW. This Agreement shall be governed and subject to the laws located in the jurisdiction of Premise’s location.Guest agrees if they are inviting other guests or occupants staying with them, or Guest is booking on behalf of a party, group, organization or entity, then Guest acknowledges and accepts all of the terms on behalf of all aforementioned parties, and represents and warrants they have the authority to bind all parties to these Terms. Guest agrees, acknowledges, accepts and will abide by the policies, terms of service, conditions, rules and other terms listed, or summarized available on Hosts website https://www.missinghotel.com or in written form which may be provided to guest onsite. Privacy Policy
ELECTRONIC SIGNATURES. Guest agrees that electronic signatures, whether digital or encrypted, of the parties included in this Agreement, if any, are intended to authenticate this writing and to have the same force and effect as manual signatures. The term “electronic signature” means any electronic sound, symbol, or process attached to or logically associated with a record and executed and adopted by a party with the intent to sign such record, including but not limited to clicking an acceptance box and or electronically signing at booking, guest registration or otherwise as required by Host. 
CONSENT Guest acknowledges they have read, understood, and accept the terms of this agreement by clicking an acceptance box, and/or electronically signing when booking, registering as a guest or otherwise as required.
